Shipping Act of 2004

The Merchant Shipping Act of 1982 with which the Registration of vessels under the flag of St.Vincent and the Grenadines commenced has been replaced by a more comprehensive and up to date legislation in the form of the Shipping Act of 2004.

This Act has adopted the International Convention on Maritime Liens and Mortgages 1993..."but without prejudice to any transaction enacted prior to the date which the provisions of Article 1-11 of the Brussels Convention 1926 applied."

Types of Vessels

St.Vincent and the Grenadines has been a member of the IMO since 1980 and is also a member of the Baltic Exchange. St.Vincent and the Grenadines rank among the top 15 fleets in the world. Registered vessels include containers, bulk carriers, tankers, yachts, tugs, drilling platforms, liners, and passenger ships.

Ships' Registry Locations

This jurisdiction provides the convenience of choices of a Ships' Registry in Kingstown, St.Vincent and the Grenadines (the Home Port) and the office of the Commissioner for Maritime Affairs based in Geneva and Monaco which office is also empowered under the law to perform the duties of the Registrar of Shipping.

Registering Entities

A vessel may be registered under the flag by:

  • An individual who is a citizen of and a resident of St.Vincent and the Grenadines
  • A corporate entity or registered association registered under the appropriate laws of St. Vincent and the Grenadines or a partnership
  • A corporate entity, association or partnership registered out of the jurisdiction but which has appointed a Registered Agent in St.Vincent and the Grenadines.

Length of Service Restrictions

A vessel that is more than 18 years old will not be accepted for registration (unless special permission is given) expect in the case of vessels registered for scrap purposes. In the case of tankers these must not be more than 15 years old.

Documentation

To effect registration of a vessel under the St.Vincent and the Grenadines Flag, the following documents are required:

  • Application For Registration completed and duly executed
  • Proof of ownership in the form of a notarized Ships' Bill of Sale or in the case of a new vessel the Builder's Certificate
  • If owned by a corporate entity, a certificate of Good Standing or Certificate of Incorporation in the case of a new company
  • A recent Transcript of the Register
  • A Deletion Certificate from the previous registry (where applicable)
  • A copy of the existing Tonnage Certificate or Certificate of Measurement
  • Classification Society confirmation of the class of the vessel
  • An Accounting Authority Identification Code (A.A.I.C) and confirmation of responsibility for radio traffic accounts
  • Safety Management Certificate (where applicable)
  • Ship's Carving and marking Notes varied by the Classification Surveyor
  • Original Radio Installation Survey Report verified by the Classification Surveyor
  • Certificate of Entry from P & I and Insurer
  • Continuous Synopsis Record (where applicable for I.S.P.S Code)
  • Good Standing Certificate of Bareboat Charterer (for Bareboat registration only)
  • Copy of the Bareboat Charter Party
  • Written consent from the Foreign flag state for vessel to fly SVG flag for period of charter
  • Consent in writing from mortgagees (where applicable)
